These Terms & Conditions (“Terms”) govern your access to and use of the Gallery 3C website, www.g3c.in, and purchases made through our online store.

Gallery 3C (“G3C”, “we”, “us” or “our”) is operated by Excel Industries. Our website presents contemporary Indian art, including original paintings, works on paper, sculptures, limited-edition prints and other artworks. 

By accessing or using our website, you agree to these Terms and our applicable Privacy Policy, Shipping Policy and Return, Cancellation & Refund Policy. If you do not agree to these Terms, please do not use the website.

Nothing in these Terms excludes or limits any rights that cannot lawfully be excluded or limited under applicable law.

2. Definitions

“Website” - The Gallery 3C website and online store at www.g3c.in.

“Artwork” - Any painting, sculpture, print or other artwork offered, displayed or sold through our website.

“Customer or Buyer” - A person who accesses the website, makes an enquiry or purchases an artwork.

“Seller” - Excel Industries or, where applicable, an artist, consignor or other party whose artwork is offered for sale through G3C.

“Description” -  The information provided about an artwork, which may include the artist's name, title, medium, dimensions, year, edition details, signature, provenance and other relevant information.

3. Use of the Website

You agree to use our website lawfully and responsibly. You must not:

• Use the website for fraudulent, unlawful or unauthorised purposes.
•  Attempt to gain unauthorised access to the website, its systems or another person's account.
• Interfere with the website's operation, security or availability.
• Submit false, misleading, defamatory or unlawful information.
• Copy, reproduce or use website content in a manner that infringes intellectual property rights.

We may take reasonable steps to protect the website, investigate suspected misuse and restrict access where necessary and permitted by law.

4. Artworks and Descriptions

G3C aims to provide accurate and useful information about each artwork. Descriptions may include the artist, title, medium, dimensions, year, edition details and other relevant information.

Because artworks are individually created, certain characteristics, including texture, surface, colour, brushwork and finish, may vary naturally.

Images are intended to represent the artwork as accurately as reasonably possible. Colours and appearance may vary depending on your screen, device, lighting and photographic conditions.

Dimensions, edition details, signatures, provenance and other information will be provided where available and applicable. Please contact us if you require clarification or additional images before purchasing.

We will take reasonable care to ensure that material information about an artwork is accurate. Nothing in these Terms permits us to misrepresent an artwork or limits any rights you may have where an artwork is materially different from its description.

5. Authenticity and Certificates

Where applicable, information about authenticity, artist signatures, edition numbers and certificates of authenticity will be provided in the relevant artwork listing or accompanying documentation.

Any certificate or authenticity representation relates to the particular artwork identified in the relevant documentation. Customers may contact G3C before purchase if they require clarification about the documentation available for a particular work.

G3C will provide the authenticity documentation expressly stated to be included with the artwork. We will not represent that a certificate, provenance record or other document exists unless it is available or otherwise confirmed.

6. Prices and Availability

Artwork prices are displayed on the website in the currency indicated at the time of purchase. Applicable taxes, shipping charges and other costs will be disclosed as required before an order is completed.

Prices and availability may change without prior notice. A change to a listing will not, by itself, alter the terms of an order that has already been accepted, subject to applicable law.

Original artworks and limited-edition works may be unique or available in limited quantities. An artwork may become unavailable because it has been sold through G3C or another authorised channel.

If an artwork becomes unavailable after an order is placed, we will contact you and explain the available options, including cancellation and refund where applicable.

If a material pricing or listing error is identified, we will contact you before proceeding where reasonably possible. We will not use a pricing error provision to avoid obligations imposed by applicable law.

7. Orders and Order Acceptance

When you place an order, you agree to provide accurate contact, billing and delivery information.

An order acknowledgement or automated email confirms receipt of your order but does not necessarily constitute final acceptance of the order.

Where necessary, G3C may contact you to verify order details, confirm artwork availability, clarify shipping arrangements or address payment issues.

An order will be accepted in accordance with the checkout process and applicable communications from G3C. If we cannot fulfil an order, we will notify you and arrange any applicable refund.

8. Payments

Payments are processed through Shopify's checkout and the payment methods made available at the time of purchase.

You must provide accurate payment information and use a payment method that you are authorised to use.

Orders may be subject to payment verification and fraud-prevention checks. We will communicate with you if an issue prevents an order from being processed.

Any applicable taxes and shipping charges will be disclosed in accordance with the checkout process and applicable law.

9. Shipping and Delivery

Shipping methods, charges, estimated delivery times, international customs charges and other delivery conditions are described in our Shipping Policy.

Delivery estimates are indicative and may vary depending on the destination, courier service, packaging requirements, customs clearance and other circumstances.

Customers are responsible for providing accurate delivery details. Please contact G3C promptly if your order arrives damaged or incorrect.

10. Cancellations, Returns and Refunds

Our Return, Cancellation & Refund Policy explains the circumstances in which an order may be cancelled, an artwork returned and a refund provided.

Due to the unique or limited nature of many artworks, G3C generally does not accept returns for a change of mind, subject to applicable law.

If an artwork arrives damaged, is incorrect or materially differs from its description, please contact us promptly so that we can investigate and determine an appropriate resolution.

Nothing in these Terms or our related policies excludes or restricts any mandatory consumer rights or remedies available under applicable law.

11. Intellectual Property

Unless otherwise stated, the website's design, text, graphics, logos, photographs, artist biographies, artwork descriptions and other website content are protected by applicable intellectual property laws.

Copyright in an artwork generally remains with the artist or other relevant rights holder unless expressly transferred under a separate agreement.

Purchasing an artwork does not, by itself, transfer copyright or grant permission to reproduce, publish, distribute, commercially exploit or create derivative works from the artwork.

You may view the website for personal, non-commercial purposes. You must not reproduce, distribute, modify, publish or commercially use website content or artwork images without permission from the relevant rights holder, except where permitted by law.

Requests to reproduce artwork images or other protected content should be directed to G3C, which can advise on the appropriate rights holder or permission process.

12. Customer Accounts, Reviews and User Content

Where account functionality is available, you are responsible for maintaining the confidentiality of your login credentials and for notifying us if you suspect unauthorised account access.

You must provide accurate information when creating an account or submitting a review.
